Documents That a Notary Cannot Notarize:

  • Vital Certificates: Birth, Marriage, Death, Divorce, etc., 
  • Photographs 

A Notary may not certify a copy of a vital record, public record, or publicly recorded document. A Notary must ensure the original document is photocopied, and the photocopy must be made under the Notary’s supervision (OCGA 45-17-8[a][6]).

  • If your loved one is in the HOSPITAL, NURSING HOME, JAIL, or any other facility and has an urgent need to have a document Notarized, please call me and make an appointment. As a Notary Public, I must make sure the signer is coherent and aware of the documents they are signing. 

 

  • Hospitals do provide Advanced Directive forms. They include a Living Will, a Durable Power of Attorney for Medical Affairs (this one has the advanced directives ), and a Durable Power of Attorney for Financial Affairs. You may even see a Last Will & Testament in this package as well.

Additional information

1. DO NOT SIGN document until you are in the presence of the Notary. Acknowledgment Certificate is OK to sign in advance.

 

2. If you have questions about completing the document, contact the person who drafted or requested the document. A Notary Public cannot provide legal advice or assistance in the drafting or completion of documents.

 

3. Every signer must physically appear, be coherent, and present acceptable I.D. at the time of notarization.  IDENTIFICATION PROBLEMS- SEE BELOW

 

4. Original documents must be presented for all Copy Certifications.  Vital records (birth, death, and marriage) cannot be notarized.

 

5. Know which Notary Certificate you need. A Notary cannot give advice on which one to use.

All identification cards must be ORIGINAL, Non-Expired, contain a photo, physical description, signature, and serial number. The Georgia Secretary of State mandates identification procedures. The following forms of identification are acceptable:

 

  • Driver’s license or non-driver’s ID issued by any state, territory, Mexico, or Canada
  • U.S. Passport
  • Properly stamped foreign passport
  • Military ID for military personnel and their dependents
  • Permanent resident card

 

Compare signature on ID to the signature on the document. Compare the photo or physical description on ID to the appearance of your signer.

 

  • Name variations
    • If the first or middle names differ,
      • It is fine if the first or middle name is an initial in the document but is the full name on the ID card.
      • It is not fine if the ID has an initial and the document has the full name
    • Last names, or surnames, and suffixes should always be the same

An ID in your maiden name along with a marriage license evidencing your married name is not acceptable. (see below how to use Credible Witnesses).

If any of the Identification mentioned above forms are not available, or the name on your I.D. is different/shorter than what is on the document, then you can use:

 

TWO CREDIBLE WITNESSES – that can swear to the signer’s identity. They must have proper ID, be 18+ years old, know the signer by the name on the document, are not named in the document, or have a financial interest in the transaction described in the document. 

 

SIGNING BY “X” MARK  –  If the signer cannot sign and has a Valid ID, two “disinterested” witnesses and witnesses on the document must be present. One witness should write the person’s name next to the person’s mark, and then the witness should sign their name as a witness. The witnesses are only verifying they witnessed the individual make their mark on the document.

  • Faxed or copied signatures
  • Incomplete documents
  • Signer not present (except for Proof of Execution by Subscribing Witness)
  • Improper ID (need 2 disinterested Credible Witnesses)
